Incest suspect barred from witnesses

Granting a request made by the Clallam County Prosecuting Attorney's Office, Superior Court Judge Kenneth Williams has further restricted Gail Elaine Smith's contacts while she is in the court system.

Smith, 39, of Sequim, no longer can contact a witness in the case, an 18-year-old female who reportedly was present during the filming of a pornographic video that also featured Smith and her 9-year-old daughter, according to court documents.

The prosecution's motion to restrict Smith stated Smith had been contacting the witness during court proceedings and that the woman had asked that Smith no longer contact her.

Smith has a scheduled trial date for April 6. She is charged with first-degree child molestation, sexual exploitation of a minor, second-degree incest with a victim under the age of 14, dealing in depictions of a minor engaged in sexually explicit conduct.

The charges originate from a video found at her estranged husband's Sequim home when Clallam County Sheriff's deputies were looking for information regarding his molestation charge. It showed Smith, the witness and Smith's 9-year-old daughter in sexually explicit acts.

Russell Jeffry Rees, 34, the estranged husband, is being charged with first-degree rape of a child, first-degree incest, first-degree child molestation, possessing depictions of minors engaged in sexually explicit conduct and dealing in depictions of a minor engaged in sexually explicit conduct.

Rees' role in the videos has not been reported, other than his possession and possible distribution of them online.

Rees is being held in the Clallam County Correctional Facility on $100,000 bail. Smith posted her $10,000 bail and has been staying with a friend in Sequim.
